Southern CaliforniaAimee Creed is a Partner at d’Arcambal Ousley & Cuyler Burk LLP (“DOCB”) and based in the firm’s New York City office. Ms. Creed has several years’ experience defending major insurance companies in litigation involving life, health, and disability insurance, including matters involving both individual and ERISA and non-ERISA group plans and allegations of bad faith, consumer fraud, rescission, and agent liability. Ms. Creed has also litigated several other matters involving commercial transactions, mortgages, banking, garnishments, breach of contract claims, and broker-dealer negligence, including Financial Industry Regulatory Authority (FINRA) actions. In addition to the firm’s extensive litigation practice, Ms. Creed focuses a substantial amount of time working with clients on pre-litigation matter assessments and resolutions. Ms. Creed’s practice also includes protection and enforcement of the subrogation and reimbursement rights of ERISA plan holders and medical insurance companies and their affiliates in a variety of tort and workers’ compensation actions. Ms. Creed and others at the firm also provide substantive contract review and negotiation for both small and large companies.
DOCB serves as national counsel in insurance interpleader actions for several major insurance companies throughout the country and Ms. Creed plays a senior role in the program’s management and litigation of those cases. When serving as national counsel in these Interpleader actions, DOCB substantively handles the case from matter inception, beginning with initial investigative work to determine the necessary party-claimants and legal issues involved, through case resolution, requiring deposit or other distribution of the proceeds at issue and dismissal of all claims against the company, including successful defeat of bad faith, breach of contract and other extra-contractual claims alleged. In this role, Ms. Creed also has extensive experience effectively and efficiently managing and collaborating with local counsel firms throughout the country.
Ms. Creed served as Co-Chair of the NAMWOLF Insurance Practice Area Committee 2015-2020. Prior to joining DOCB, Ms. Creed was a litigation associate at a large law firm in New York City focusing on Products Liability, Mass Torts and Consumer Fraud defense and began her career as a general commercial litigation associate at a mid-size firm in New Jersey. Ms. Creed grew up in Southern California before moving to New York City for law school.
